U.S. agencies may not be doing enough to accumulate Bitcoin in accordance with the March executive order signed by President Donald Trump, Sen. Cynthia Lummis (R-WY) fears.
“Why is the U.S. gov still liquidating bitcoin when @POTUS explicitly directed these assets be preserved for our Strategic Bitcoin Reserve?” Lummis said Tuesday on X, citing a Bitcoin Magazine report that the U.S. Court for the Southern District of New York sold Bitcoin tied to the Samourai wallet case.
“We can’t afford to squander these strategic assets while other nations are accumulating bitcoin,” Lummis continued. “I’m deeply concerned about this report.”

Samourai wallet was a privacy-focused Bitcoin wallet that used tools to allow users to conceal the origin of transactions. The service was taken down in 2024 following a federal investigation that culminated in the developers Keonne Rodriguez and William Lonergan Hill pleading guilty to operating an unlicensed money transmitter.
Rodriguez and Hill were each sentenced to five and four years in prison. They also jointly paid $6.4 million in forfeiture, representing the fees earned from Samourai’s operation.
Rodriguez and Hill paid the $6.4 million in BTC, Bitcoin Magazine reported Monday, adding that it had likely been sold by the Marshals Service. The Marshals Service had potentially violated Trump’s executive order directing agencies to hold on to digital assets from criminal or civil forfeitures as part of a national reserve, Bitcoin Magazine reported.

The report cited court documents granting the Marshals Service permission to liquidate the Bitcoin and on-chain data showing that the assets had been sent to Coinbase’s (NASDAQ:COIN) institutional-facing Coinbase Prime unit.
However, the Marshals Service has denied selling the Bitcoin in question, cryptocurrency news outlet DL News reported.
“USMS cryptocurrency liquidations go through a multi-level approval process to ensure only forfeited digital assets that meet the requirements of Section D of Executive Order 14233 are disposed,” the agency reportedly told DL News.
The Marshals Service did not immediately respond to a request for comment from Benzinga.

Lummis has said a substantial Bitcoin reserve could help the U.S. eliminate its national debt. The view is based on the belief that Bitcoin is a store-of-value asset and that its price will continue to rise over time.
Lummis introduced the BITCOIN Act in 2024, offering a blueprint for the U.S. to accumulate 1 million BTC over five years. The bill failed to gain traction before the end of that legislative year and was reintroduced in 2025.
